NJEMANYI LIMITED ("NJEM", "the Company", "we", "us", or "our") operates the NJEM mobile application and marketplace platform. We are committed to protecting the privacy and personal data of our users, including customers, e-commerce merchants, and dispatch riders ("Users", "you").

This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information in strict accordance with the Nigeria Data Protection Act (NDPA). By downloading, registering, or utilizing the NJEM application, you explicitly consent to the data practices described in this policy.

1. INFORMATION WE COLLECT

To provide a secure, cashless, and geofenced e-commerce and logistics service, we collect the following categories of data:

A. Personal Identification Information

  • Account Registration: Name, email address, mobile phone number, physical store or residential address, and profile picture.
  • Verification Data: For merchants and riders, we may collect government-issued identification cards, utility bills, business registration documents (CAC), and rider licenses to prevent platform fraud.

B. Location Data (Crucial for Operations)

  • Real-Time GPS Tracking: We collect precise location data from your mobile device when the app is running in the foreground or background.
  • Rider & Package Monitoring: For riders, background location data is continuously tracked to calculate fuel efficiency, monitor delivery routes, and provide live map tracking to the customer.
  • Customer Pin Drops: For customers, location data is used to match delivery drop-off points with our geofencing matrix.

C. Financial and Transactional Information

  • Cashless Upstream Payments: All payment details (card numbers, bank account numbers, tokens) are processed securely by our PCI-DSS compliant third-party payment gateways (e.g., Paystack, Flutterwave). NJEM does not store your raw credit/debit card numbers on our servers.
  • In-App Wallet: We log transaction histories, wallet balances, refund allocations, and promotional referral credits.

D. Device and Technical Data

IP addresses, device hardware models, operating systems, mobile network provider data, and unique app crash logs.

E. Media and Camera Permissions

We require access to your mobile device's camera to enable dispatch riders to snap and upload Visual Proof of Delivery (PoD) photos at the doorstep, and for users to upload profile photos.

2. HOW WE USE YOUR INFORMATION

NJEM processes your personal data strictly for lawful commercial purposes, including:

• Provisioning and maintaining your e-commerce and delivery orders.

• Generating and transmitting the unique 4-digit Delivery Verification OTP.

• Displaying real-time rider tracking maps to merchants and customers.

• Reconciling payment settlements and managing your non-withdrawable in-app wallet balance.

• Detecting, investigating, and preventing digital transaction fraud, chargeback scams, or vehicle tracking tampering.

• Compiling anonymized operational statistics (e.g., popular delivery zones in Enugu).

3. DATA SHARING AND DISCLOSURE

We do not sell your personal data to third parties. We only share information under the following operational conditions:

  • With Dispatch Riders / Customers: We share the customer’s name, phone number, and delivery address with the assigned rider, and the rider's name, bike registration number, and live GPS coordinates with the customer to facilitate delivery.
  • With Payment Processors: Transaction details are securely shared with our licensed financial payment partners to verify upstream payments.
  • For Legal and Regulatory Compliance: We will disclose data to Nigerian law enforcement agencies or state regulators (e.g., Enugu State Ministry of Transport) if contractually or legally compelled to do so, or to invalidate fraudulent bank chargeback claims using our logged system data.

4. DATA SECURITY AND RETENTION

Security Controls: We deploy industry-standard Secure Sockets Layer (SSL) encryption, firewalls, and tiered admin level access permissions to prevent unauthorized access, loss, or alteration of user data.

Retention Lifecycle: We store your personal information for as long as your account remains active. Transaction historical logs are archived for the duration required under Nigerian financial record-keeping laws before permanent deletion.

5. YOUR DATA PROTECTION RIGHTS

Under the Nigeria Data Protection Act (NDPA), you possess the following rights:

  • Right of Access: You can request a digital copy of the personal data we hold about you.
  • Right to Rectification: You can edit your name, address, or bank coordinates inside the app profile settings at any time.
  • Right to Erasure ("Right to be Forgotten"): You may request the permanent deletion of your NJEM account, provided you have zero outstanding delivery disputes, no debt liabilities, and your in-app wallet is fully settled.

6. CHILDREN’S PRIVACY

The Platform is not intended for individuals under the age of 18. We do not knowingly collect personal data from minors. If we discover a minor has registered an account, it will be deleted immediately.

7. CHANGES TO THIS PRIVACY POLICY

NJEM reserves the right to modify this policy at any time to reflect changing local regulations. We will notify you of significant text changes via an in-app pop-up notification or email broadcast. Continued use of the app after modifications constitutes acceptance of the terms.
